Terms of Service

Effective Date: 1 October 2026

These Terms of Service (“Terms”) govern the use of the facilities, services, booking system, membership and activities provided by Smart MBS Arena (Smart Sports Arena - 202603 121439).

By making a booking, registering for membership, participating in an activity, or entering and using the facilities of Smart MBS Arena, the user (“User”, “Customer”, “Participant” or “you”) acknowledges that they have read, understood and agreed to comply with these Terms.

1. FACILITY USE

1.1 Smart MBS Arena provides sports and recreational facilities for football, training, coaching, tournaments, leagues, academy activities, community programmes, corporate activities and other activities approved by the Management.

1.2 Smart MBS Arena primarily provides the facilities and venue. Users, organisers, teams, academies, coaches, participants and spectators are responsible for their own conduct, safety and belongings while using or entering the premises.

1.3 Users must use the facilities responsibly and only for the purpose for which the facilities have been booked or approved.

1.4 The Management reserves the right to refuse or terminate the use of the facilities where there is a breach of these Terms, safety concerns, misuse of facilities or any conduct that may affect other users or the property of Smart MBS Arena.

2. USE AT OWN RISK

2.1 All users, participants, coaches, organisers, spectators, parents, guardians and other persons entering Smart MBS Arena do so at their own risk.

2.2 Participation in football, sports, training, tournaments and other physical activities carries inherent risks, including but not limited to falls, collisions, muscle injuries, fractures, medical emergencies and other physical injuries.

2.3 Users are responsible for determining whether they are physically fit and medically suitable to participate in any activity.

2.4 Users are encouraged to obtain appropriate personal accident, medical or sports insurance where necessary.

3. INJURY, ACCIDENT, MEDICAL EMERGENCY & DEATH

3.1 To the fullest extent permitted by applicable law, Smart MBS Arena shall not be responsible or liable for any injury, accident, illness, disability or death arising from or in connection with the use of the facilities or participation in activities at the premises, except to the extent such liability cannot lawfully be excluded.

3.2 In the event of an accident or medical emergency, the Management may contact emergency services or the relevant authorities where reasonably necessary.

3.3 Users are responsible for their own medical expenses, treatment, medication, insurance claims and other costs arising from any injury or medical condition.

3.4 Parents or legal guardians are responsible for minors under their care and must ensure that the minor is appropriately supervised during their time at the premises.

4. PERSONAL BELONGINGS, LOSS & THEFT

4.1 Users are solely responsible for their personal belongings and property brought into Smart MBS Arena.

4.2 This includes, but is not limited to, mobile phones, wallets, cash, watches, bags, football boots, sports equipment, vehicles, vehicle accessories and other personal items.

4.3 To the fullest extent permitted by applicable law, Smart MBS Arena shall not be responsible for any loss, theft, damage or disappearance of personal belongings or property belonging to users, participants, organisers or spectators.

4.4 Users are advised not to leave valuable items unattended.

5. FIGHTING, MISCONDUCT & UNWANTED INCIDENTS

5.1 Fighting, physical assault, threatening behaviour, harassment, intimidation, abusive language, aggressive behaviour or any form of disorderly conduct is strictly prohibited.

5.2 Any person involved in a fight, violent incident or serious misconduct may be immediately removed from the premises without refund.

5.3 The Management reserves the right to contact the police or other relevant authorities where necessary.

5.4 Users and organisers are responsible for maintaining proper behaviour and discipline among their participants, teams, coaches, staff and spectators.

6. PROHIBITED ITEMS & ACTIVITIES

For the safety of all users and to protect the pitch, equipment and facilities, the following are strictly prohibited unless prior approval has been obtained from the Management:

6.1 Smoking, Vaping & Tobacco Products

Smoking, vaping, e-cigarettes and the use of tobacco or smoking-related products are prohibited in areas where such activities are not permitted by the Management or applicable law.

6.2 Pets & Animals

Pets and animals are not allowed within the pitch area or facility premises, except for authorised service animals where applicable.

6.3 Foldable Chairs, Tables & Damaging Items

Foldable chairs, tables, heavy furniture, sharp objects, metal equipment or any other items that may damage the artificial turf, natural grass, flooring, goalposts, nets, fencing or other equipment are not permitted within the pitch area without prior approval.

6.4 Banners, Buntings, Posters & Signs

No banners, buntings, posters, advertisements, promotional materials or signs may be displayed, installed or attached to any part of the pitch or facility without prior approval from the Management.

6.5 Electrical Cables & Power Lines

Electrical cables, extension cords or power lines must not extend across or outside the designated pitch area unless prior approval has been obtained and appropriate safety measures are in place.

6.6 Burning & Open Fire

Burning of any materials, lighting of open fires, fireworks, firecrackers or any activity involving uncontrolled flames or fire is strictly prohibited.

6.7 Improper Disposal of Waste

Disposal of rubbish, food waste, oil, chemicals or other materials into sinks, drains, toilet bowls or toilet holes is strictly prohibited.

6.8 Washing Activities in Restrooms

Washing of shoes, sports equipment, clothing, food containers or other items inside restrooms, sinks or toilet areas is strictly prohibited.

6.9 Food & Drinks

Food and beverages may only be consumed in designated areas. Glass containers and items that may damage or contaminate the pitch are not permitted within the pitch area.

6.10 Sharp or Hazardous Items

Knives, sharp objects, hazardous materials, flammable substances or any item that may pose a safety risk or damage the facilities are prohibited.

6.11 Unauthorised Installation

Users must not drill, nail, screw, glue, tape, attach, modify or install any item onto the pitch, walls, fencing, goalposts, nets, flooring or other facility structures without prior approval.

6.12 Illegal or Dangerous Activities

Any activity that is illegal, dangerous, disruptive or reasonably likely to cause injury, property damage or disturbance to other users is strictly prohibited.

6.13 Unauthorised Equipment

Any equipment brought into Smart MBS Arena must comply with the Management's requirements. The Management may prohibit any equipment considered unsuitable or potentially damaging to the facility.

6.14 Management's Right to Remove Items

The Management reserves the right to prohibit or require the immediate removal of any item which, in its reasonable opinion, may damage the facilities, interfere with operations or create a safety risk, even if the item is not specifically listed in these Terms.

7. DAMAGE TO PROPERTY & FACILITIES

7.1 Users must not intentionally or negligently damage, misuse, move, alter or interfere with the pitch, goalposts, nets, fencing, lighting, furniture, toilets or other Smart MBS Arena facilities.

7.2 Any user, organiser, team, academy, participant or spectator responsible for damage may be required to pay the cost of repair, replacement or restoration.

7.3 The Management may determine the reasonable cost of repair or replacement based on the extent of the damage.

8. BOOKING & PAYMENT

8.1 All bookings are subject to availability and confirmation by Smart MBS Arena.

8.2 A booking is considered confirmed only upon receipt of the required payment or confirmation specified by the Management.

8.3 Users must only use the pitch according to the date, time, duration and facility stated in their booking.

8.4 Users are not permitted to extend their usage beyond the booked time without prior approval.

8.5 Additional charges may apply for unauthorised extension of usage.

9. CANCELLATION & RESCHEDULING

9.1 Cancellation and rescheduling are subject to the cancellation policy applicable to the booking.

9.2 The Management reserves the right to refuse cancellation or refund where the applicable cancellation requirements have not been met.

9.3 Where the facility is required to close due to circumstances beyond the Management's reasonable control, the Management may offer rescheduling or other arrangements at its discretion.

10. WEATHER & UNFORESEEN CIRCUMSTANCES

10.1 Outdoor activities may be affected by heavy rain, lightning, flooding, unsafe pitch conditions or other weather-related circumstances.

10.2 The Management may temporarily suspend or stop activities where continuing the activity may pose a safety risk.

10.3 The Management may also temporarily close the facility due to maintenance, emergencies, government instructions, safety concerns or other circumstances beyond its reasonable control.

11. TOURNAMENTS & EVENTS

11.1 Organisers are responsible for the overall management and conduct of their tournament, league or event.

11.2 Organisers are responsible for their participants, coaches, officials, spectators, equipment and event activities.

11.3 Organisers must comply with all instructions given by the Management.

11.4 Organisers are responsible for ensuring that their event does not cause damage, excessive disturbance, obstruction or safety hazards within the premises.

11.5 The Management reserves the right to stop an event if there is a serious breach of these Terms or a significant safety concern.

12. PARKING & TRAFFIC MANAGEMENT

12.1 All users must park only in designated or permitted parking areas.

12.2 Parking must not obstruct entrances, exits, emergency access, neighbouring properties or public roads.

12.3 Organisers are responsible for assisting with proper traffic and parking management during tournaments and large-scale events.

12.4 Any complaint, enforcement action or penalty arising from improper parking or traffic obstruction caused by an organiser's event may be the responsibility of the relevant organiser, subject to applicable law.

13. CHILDREN & MINORS

13.1 Children and minors must be supervised by their parent, legal guardian, coach, academy representative or another responsible adult.

13.2 Smart MBS Arena does not assume responsibility for the supervision of children or minors unless expressly agreed in writing.

13.3 Parents or guardians are responsible for ensuring that children comply with these Terms and the rules of the facility.

14. CLEANLINESS

14.1 All users must keep the facilities clean and dispose of rubbish in the designated waste collection areas.

14.2 Users must not leave bottles, food containers, packaging, tape, clothing, equipment or other waste on the pitch or surrounding areas.

14.3 Organisers may be required to arrange additional cleaning after events depending on the scale and nature of the activity.

15. SECURITY & MANAGEMENT AUTHORITY

15.1 The Management may take reasonable steps to maintain safety, security, cleanliness and proper use of the facilities.

15.2 The Management reserves the right to ask any person who violates these Terms or poses a safety risk to leave the premises.

15.3 Serious incidents may be reported to the relevant authorities.

15.4 The Management may refuse future bookings or membership access where a user repeatedly breaches the Terms or causes damage, disturbance or safety concerns.

16. LIMITATION OF LIABILITY

16.1 Smart MBS Arena provides facilities for users to conduct approved activities but does not guarantee that the use of the facilities will be free from all risks, accidents or incidents.

16.2 To the fullest extent permitted by applicable law, Smart MBS Arena, its management, employees, representatives and appointed personnel shall not be liable for loss, injury, accident, theft, damage, death or other loss arising from a user's use of the facilities or participation in activities, except where such liability cannot legally be excluded.

16.3 Nothing in these Terms is intended to exclude or restrict any liability that cannot lawfully be excluded or restricted under applicable Malaysian law.

17. USER RESPONSIBILITY & INDEMNITY

17.1 Users and organisers are responsible for their own actions and the actions of persons under their supervision or control.

17.2 To the extent permitted by applicable law, users or organisers may be responsible for losses, claims, costs or expenses incurred by Smart MBS Arena as a result of their breach of these Terms, negligence, misconduct or damage caused to the facilities.

18. MANAGEMENT'S RIGHT TO AMEND TERMS

18.1 Smart MBS Arena reserves the right to amend, update or modify these Terms from time to time.

18.2 The latest version of these Terms may be made available through the Smart MBS Arena website, booking system or other official communication channels.

18.3 Continued use of the facilities after the updated Terms take effect constitutes acceptance of the revised Terms.

19. ACCEPTANCE OF TERMS

By making a booking, registering for membership, participating in an activity, entering or using the facilities of Smart MBS Arena, the User acknowledges that:

●     They have read and understood these Terms of Service;

●     They agree to comply with all rules and requirements;

●     They understand that sports and physical activities carry inherent risks;

●     They are responsible for their own safety and personal belongings;

●     They agree to use the facilities responsibly;

●     They accept the applicable terms regarding liability, damage, loss and conduct; and

●     They understand that Smart MBS Arena primarily provides the facilities and venue for approved activities.

Smart MBS Arena reserves the right to take appropriate action against any person who fails to comply with these Terms.
